CONTEST RELEASE OF RIGHTS AND OFFICIAL RULES
No purchase or obligation necessary to participate and win. U.S. residents 18 and over are invited to participate. The Greater Philadelphia Cultural Alliance (hereafter referred to as the “contest partner”) has the right to determine eligibility of contest winners. Employees of the contest partner, their immediate families (spouses, parents, children and siblings, and each of their respective spouses), and members of the household of such individuals are not eligible to register for the contest. The contest partner has the right to determine eligibility.
2. How to Enter the Contest:
The contest begins at 9:00 a.m. on March 11, 2019 and ends at 11:59 p.m. on March 17, 2019.
To enter the Contest, the contestant (the “Contestant”) must access the contest application via Phillyfunguide.com, or through a link provided either through a Facebook post or another contestant’s referral. Then, the Contestant must fill out the form on contest application and provide the following mandatory information: (i) first name; (ii) last name; (iii) email address; (iv) phone number; and confirm that (vii) he/she has read and agreed to the contest rules, before the Contest Closing Date, to be automatically entered.
The Contestant may use the custom link he/she will receive upon entering in order to invite additional friends to enter.
The Contestant who has completed the online entry form is eligible for the Prize (defined below) draw, to be held March 18, 2019 at 8:00 a.m.
3. Prizes: One pair of tickets to Philadelphia Orchestra at the historic Keswick Theatre on Thursday, March 21, 2019 at 7:00 PM.
4. Prize Claim:
In order to be declared a winner, the selected Contestants must:
Fill in the entry form and complete and answer all the compulsory fields; Be reached by email by the Organizer of the Contest within twenty-four (24) hours after the draw. If it is impossible to reach the selected Contestant by email within forty-eight (48) hours after the draw, all rights to the Prize will be forfeited and another entry will be drawn. If it is impossible to reach the second selected Contestant by email within forty-eight (48) hours of the draw of the second entry, all rights to the Prize will be forfeited and another entry will be drawn. If it is impossible to reach the third selected Contestant by email within forty-eight (48) hours of the draw of the third entry, the prize will be forfeited.
The winners will be named within thirty 30 days following the draw date for the Prize.
In default of observing any of the conditions mentioned above or any other conditions stipulated in these Rules, the selected Contestant will be disqualified and the Prize that would have been awarded will be forfeited. Within the days following receipt of confirmation that the winner received notification about their Prize, the Organizer of the Contest will contact the winner to inform him/her of how to claim the Prize.
5. Personal Information:
From time to time, the Organizer, with the Contestant’s consent, may use the personal information provided in the entry form for the purpose of: Communicating with the winner so he/she can take possession of the Prize; Communicating with the Contestant directly in relation to goods and services offered by the Organizer, including special offers and information on local events; and conducting a survey regarding the effectiveness of the website, advertising and sales efforts made by the Organizer.
The Contestant shall indicate whether he/she consents to his/her personal information provided on the entry form being used by checking the box to this effect on the official entry form.
6. General Rules:
By participating, entrants and voters (and parent/legal guardian if entrant/voter is a minor) agree to these official rules and the decisions of the contest partner, which shall be final and binding in all respects. Entrants will be disqualified if automatic voting software is used in their favor. Winners and all entrants (and parent/legal guardian if a minor), as a condition of entry/participation into the contest, agree to indemnify, defend, hold harmless and forever release the contest partner from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with participating in any aspect of the contest, the receipt, ownership or use of prize awarded or any typographical or other error in these official rules or the announcement of offering of the prizes. Acceptance of a prize constitutes permission to the contest partner to use winning entrants’ names for promotional purposes (including any possible public relations opportunities) without further compensation except where prohibited by law. The contest partner and its agencies are not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in the contest or by any human error which may occur in the processing of the entries/votes in the contest or for any liability for damage to any computer system resulting from participation in, accessing or downloading information in connection with the contest. The contest partner reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the contest; violates the official rules; acts in an unsportsmanlike or disruptive manner; or acts with intent to annoy, abuse, threaten or harass any other person. Any attempt by any person to deliberately undermine the legitimate operation of the contest may be a violation of criminal and civil law, and, should such an attempt be made, the contest partner reserves the right to seek damages from any such person to the fullest extent permitted by law. The contest partner’s failure to enforce any term of these official rules shall not constitute a waiver of that provision. The contest partner reserves the right to cancel or modify this contest or online voting for any reason, including (but not limited to) if, for any reason, the contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the contest partner which corrupt or affect the administration, security, fairness, integrity or proper conduct of the contest. If such cancellation occurs of contest or online voting, the contest partner reserves the right to determine/select the winners from among all eligible entries received prior to cancellation, based on the same criteria listed above or based on a random drawing.
