Before accepting the prize, you must read and consent to the terms of the Acknowledgment of Eligibility below.

ACKNOWLEDGEMENT OF ELIGIBILITY

1. Neither I, nor any member of my immediate family is an employee of Spirit Halloween LLC, their respective parents, subsidiary or affiliated companies, or their advertising, licensing, fulfillment or promotion agencies, agents or representatives.  Such entities, as well as the directors, officers, employees, agents and representatives of each shall hereafter be referred to, collectively, as the “Companies”. I am seeking to be declared an official winner of a $100 Spirit Halloween Gift Card

2. I am submitting this Affidavit to the Companies with the understanding that it will be relied upon to determine whether I am entitled to receive the Prize for which my entry has been selected in the promotion.  I hereby agree to accept the Prize subject to all terms and conditions of the promotion rules and of this agreement, both of which I have read in full.  Further, I represent that I have complied with all the rules and regulations of this promotion and that I have perpetrated no fraud or deception in entering or in claiming the Prize.

3. I understand and agree that should I hereafter refuse to accept the Prize, or any element thereof, then the Companies shall be released from all further obligations to me in connection with the Prize.

4. I understand that the Prize awarded to me is non-transferable, non-exchangeable, non-redeemable for cash, and is subject to availability.  No substitutions are allowed without specific written approval by the Sponsor.  I shall be solely responsible for all federal, state and local taxes on or arising in connection with the Prize awarded me.  I understand that I will be issued a tax form by the Sponsor to report the fair market value of any such Prize as earned income, and for such purpose I agree to accept the reasonable estimate of such provided by the Companies.  Further, I understand that if such tax form is issued, then it will be reported to the United States Internal Revenue Service.

5. I hereby grant to Sponsor, their designees, assignees and licensees, the worldwide and perpetual right and authority to use, publish, display and reproduce my name, photograph, animated likeness and other likeness and/or any biographical information I may provide, and any statement I may make concerning the promotion or the Prize awarded to me, in any and all media, in perpetuity, for the purpose of trade promotion and/or otherwise, without notifications or additional compensation, except where prohibited by law.

6. I warrant and represent that I am a legal resident of the United States and that I was thirteen (13) years of age or older as of August 24, 2020.

7. On behalf of myself, my relatives, heirs, assignees, executors and administrators, I hereby permanently, irrevocably and forever waive any and all claims, liabilities, losses and damages (including but not limited to court costs and attorneys’ fees) now or in the future of any kind and nature whatsoever (collectively, “Claims”) against Companies and their predecessors and successors in interest, assignees, licensees and designees (the “Released Parties”) relating in any way to: (I) the promotion, including any sweepstakes therein’ (II) any personal injury, property damage, use of my name or physical likeness as described herein, or any other injury, damage or loss resulting from the promotion, or any travel I undertake in connection with the promotion; (III) the Prize; and (IV) any acceptance or use of the Prize, and forever release and discharge the Released Parties from any and all liability with respect thereto.  I further agree that I will indemnify and hold the Released Parties harmless from and against all claims arising out of, connected with or as a result of (I) my breach of this agreement and/or (II) my acceptance and use of the Prize.

8. Without limitation of the foregoing, I agree to return the Prize if any statement made by me is false, or if I breach any of the terms and conditions hereof.

By accepting the prize, I acknowledge receipt of the Official Rules, represent that I have complied with all of the Official Rules and agree and consent to the Acknowledgment of Eligibility.
