NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.
Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules. The “Pep In Your Step Sweepstakes (the “Sweepstakes”) begins on March 15, 2018 at 12 am., Eastern Time (“CT”) and ends on March 18, 2018 at 11:59 p.m., ET ("Sweepstakes Period"). Sweepstakes is sponsored by REACH, LLC. (the "Sponsor"), 611 Commerce St, The Tower Suite 2705, Nashville, TN, 37203.
Eligibility: Sweepstakes is only open to individuals who have registered for one of the Rock ‘N Roll Marathon Series races being held in Dallas, Texas, March 24-25, 2018 (the “Race”). Individuals must also be legal residents of the 50 United States, including the District of Columbia, who has the age of majority in his or her state, or territory of residence at the time they participate in the Sweepstakes. Employees, officers, and directors (including immediate family members and members of the same household) of the Sponsor, Toyota Motor Sales USA, Inc., (the "Prize Provider") their parent companies, subsidiaries, affiliates, retailers, distributors and advertising and promotion agencies and American Sweepstakes Company, Inc. (“Administrator”), and any other entities directly associated with this Sweepstakes (collectively, “Released Parties”), are also not eligible to participate. All federal, state and local laws and regulations apply. Void in Puerto Rico and where prohibited.
How to Enter: Eligible Participants who have registered for the Race will be invited to enter the Sweepstakes from an email that they will receive from the Rock ‘N Roll Marathon team. This email will include a link to a promotional entry page where they need to submit their name, email address and choose either the 5K or the half marathon race on the entry form. This will earn then one (1) entry into the Sweepstakes. LIMIT one entry per person.
SWEEPSTAKES DRAWINGS AND NOTIFICATIONS: At the end of the Sweepstakes Period a random drawing will take place from all eligible entries that were received which will be conducted by American Sweepstakes & Promotion Co. (“the Administrator”) an independent judging organization, whose decisions are final and binding in all matters relating to this Sweepstakes. The odds of winning a prize will depend on the total number of eligible entries received. The winner will be contacted by the email address that they provided.
Prize: One (1) Grand Prize winner will receive a prize package that includes a Brooks outfit (not to exceed $500.00 U.S. Dollars) and a ride from their hotel (or home if within 60 miles of the Race) in a 2018 Toyota to the Race on the morning of Race day. The winner will receive a pep talk pre-Race from a renowned icon in the running world. The Approximate Retail Value of the Grand Prize is $1,100. The total Prize Pool is $1,100.
Prize Conditions: By accepting any prize, the prize winners agree to release the Sponsor from any and all liability whatsoever for any injuries, losses, or damages of any kind caused by entering the Sweepstakes or for damages of any kind caused by any prize or resulting from acceptance, possession, or use/misuse of prize awarded. All local, state and federal taxes are solely the responsibility of the winner. Grand Prize winner will be required to complete and sign and Affidavit of Eligibility and Liability/Publicity Release form provided to them to be returned within forty-eight (48) days of written notification, or prize may be forfeited and an alternate winner selected. The Grand Prize winner will also be required to disclose his/her social security number for the purpose of issuance of a 1099 Form for tax purposes. No substitution or transfer of prize or election of cash in lieu of prize will be permitted. The Sponsor reserves the right at its sole discretion to substitute any prize package with another prize of equal or greater value in the event that the prize (or any component thereof) is not available. If a prize or prize notification is returned as unclaimed or undeliverable to a potential winner, if potential winner cannot be reached within two (2) calendar days from the first notification attempt, or if potential winner fails to return requisite document within the specified time period, or if a potential winner is not in compliance with these Official Rules, then such person shall be disqualified and an alternate winner will be selected for the prize at issue. All taxes, if applicable, are the sole responsibility of the winner. The winner’s entry, and acceptance of the prizes offered constitutes permission (except where prohibited) for the Sponsor to use said winner’s name, photograph, likeness, statements, biographical information, voice and address (city and state), in all forms of media, in perpetuity, without notice or further compensation.
Limitations of Liability: Sponsor reserves the right to modify, terminate or suspend the Sweepstakes should an action or event beyond the reasonable control of Sponsor corrupt or impair the administration, security or fairness or proper play of the Sweepstakes. If for any reason this Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes in whole or in part, at any time, without notice and award the prizes using all non-suspect eligible Participants as of, or after (if applicable) this cancellation, termination, modification or suspension date, or in any manner that is fair and equitable. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Sweepstakes or downloading any materials in this Sweepstakes. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
Use of Data: Sponsor may be collecting personal data about the Participants in accordance with its Privacy Policy. Please review the Sponsor's Privacy Policy at the following link: at http://www.toyota.com/help/privacy.html. By participating in the Sweepstakes and providing an e-mail address, Participants hereby acknowledge and agree to Sponsor’s collection and usage of their personal information as stated in the Sponsor’s Privacy Policy and also agree that Sponsor may share this information with its dealer and partner network to alert Participants of future promotions and offers.
Terms & Conditions: This Sweepstakes is subject to all applicable federal, state, and local laws. By participating in the Sweepstakes, entrants agree to release, discharge, indemnify and hold harmless the Released Parties , and each of their respective directors, officers, employees, shareholders and agents from any and all liability, loss, damage or injuries to any person (including death) or property of any kind sustained in connection with their participation in the Sweepstakes or from their acceptance, receipt, possession and/or use or misuse of the prize, or for any typographical or other error in the printing, offering or announcement of the prize. Entrants further acknowledge that said parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee express or implied, in fact or in law, relative to the prize, including, but not limited to, its quality or fitness for a particular purpose. Any person attempting to defraud or in any way tamper with the Sweepstakes mechanics and/or implementation will be prosecuted to the fullest extent of the law. By participating, entrants agree to be bound by these Official Rules and the decisions of the Administrator, and waive any right to claim ambiguity in the Sweepstakes or these Official Rules. Sponsor reserves the right to disqualify any Participant that Sponsor determines, in its sole discretion, violates these Official Rules. This Sweepstakes is void where prohibited.
DISPUTES: Participant agrees that (1) any and all disputes, claims, and causes of action arising out of, or connected with, this Sweepstakes (including without limitation, any alleged violation of these Official Rules, any controversy relating to the arbitrability of any dispute, or any claim that these Official Rules (or any part thereof) are invalid, illegal, or otherwise voidable (or void)) shall be resolved individually, without resort to any form of class action, and exclusively by arbitration to be held solely in Los Angeles, California under the auspices of the American Arbitration Association and pursuant to its Commercial Dispute Resolution Rules and Procedures; (2) any and all claims, judgments, liabilities, and/or awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participant’s participation in this Sweepstakes or otherwise accessing this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will you be permitted to obtain awards for, and participant hereby waives, all rights to claim, punitive, special, incidental, and/or consequential damages and any other damages, other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. Judgment upon the arbitration award may be entered in any court having jurisdiction thereof. This arbitration provision shall be deemed to be self-executing, and in the event that either party fails to appear at any properly noticed arbitration proceeding, an award may be entered against such party notwithstanding said failure to appear. In no event shall participant seek or be entitled to rescission, injunctive, or other equitable relief or to enjoin or restrain the operation of this Sweepstakes, exploitation of any advertising or other materials issued in connection therewith, or exploitation of this Sweepstakes or any content or other material used or displayed on this Sweepstakes.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsors in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.
