Void where prohibited. Participation constitutes your full and unconditional agreement to these Terms Administrator’s decisions, which are final and binding in all matters related to the Casting. Being offered a virtual set is contingent upon fulfilling all requirements set forth herein.

Eligibility
Discovery Project: EDC Las Vegas Open Casting Call & SidePiece Remix Edition 2021 (“Casting”) is open to legal residents of the United States of America who have a valid social security or tax ID number, who are at least eighteen (18) years of age.

Sponsor
The Sponsor of the Casting is Insomniac Holdings, LLC (“Insomniac”).

Administrator
The Administrator of the Casting is Insomniac Holdings, LLC.

Sponsor and Administrator are collectively referred to herein as “Casting Entities”.

Timing
Administrator's clock is the official time keeping device of the Casting.

The Submission Period begins at 12:00 PM Pacific Time ("PT") on July 2, 2021 and ends at 11:59 PM PT on July 23, 2021. 

How to participate
Create a remix of the track “Acrobatic” by SidePiece and then complete the EDC Las Vegas Open Casting Call 2021 Submission form, making sure to upload your remix where indicated ("Submission"). Steps are as follows:

1. Participant must use the stems provided for “Acrobatic” to create one (1) remix of “Acrobatic” by Sidepiece (“Remix”) that captures or demonstrates contestants entrance production capabilities. Stems may be found here. 
   1. Remix should be high quality and participants are encouraged to submit via a direct audio feed. 
      
      
   2. Remix should be formatted as 320KBPS and uploaded as an .MP3 file. 
      
      
2. Next, Participant must go to https://www.insomniac.com/music/discovery-project/casting-calls/edc-las-vegas-2021-sidepiece-remix-edition/ and access the Submit tab to complete the Submission form which includes following the instructions to complete the form fields, and uploading your .MP3 file.
   
   
   1. Your Track must not be published to the public anywhere (via and method).
      
      
   2. Submission must be submitted by the creator of the Remix. 
      
      
   3. Participant must be the registered subscriber of the email account used during Submission. 

Participant may apply once during the Submission Period. Multiple Participants are not permitted to share the same email address or other relevant account. Insomniac is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected Submissions, which may be disqualified. All entries become the property of Insomniac and none will be acknowledged or returned.

As conditions of participation into this Casting, and submitting a Submission, you:

1. Warrant and represent that you have the written consent, release, and/or permission of each and every identifiable individual person in the Submission to use his/her respective name or likeness to enable inclusion and use of the Submission in the manner contemplated by Insomniac and these Terms, and can make written copies of such permissions available to Insomniac upon request; 
   
   
2. Acknowledge and agree that Insomniac may exploit, edit, modify, display and distribute the Submission and all elements of such Submission (to include the Remix), including, without limitation, the names and likenesses of any persons or locations embodied therein, in any and all media or format now known or not currently known, throughout the world in perpetuity without compensation, permission or notification to Participant or any third party;
   
   
3. Warrant and represent that your Submission is original to you, with the exception of the provided stems for “Acrobatic”, and has been legally obtained and created, does not infringe the intellectual property, privacy or publicity rights or any other legal or moral rights of any third party, or violate applicable laws or regulations;
   
   
4. Warrant and represent that your Submission does not contain any unlicensed images or music; 

In the event you cannot provide all required releases, Insomniac reserves the right, in their sole discretion, to disqualify the applicable Submission, or seek to secure the releases and clearances for Insomniac’s benefit, or allow the applicable Submission to remain.

You agree that Submissions shall not contain, include or involve any of the following:

• Obscenity
• Crude, vulgar or offensive pictures, depictions, images, language and/or symbols
• Gang signs or symbols
• Violence
• Explicit sexual activity
• Nudity
• Illegal drug or alcohol use
• Commercial products (e.g., clothing, toys, food) and/or their trademarks, brands, logos or endorsements
• License plates, phone numbers, personal addresses (physical or email or otherwise)
• Website or web page links
• Derogatory characterizations of any ethnic, racial, sexual or religious groups, humiliation of other people (publicly or otherwise), any assault or threatening of others
• Trespass or the violation of other people’s rights or property
• Illegal (e.g., discriminatory, harassing) or inappropriate activity, behavior or conduct (e.g., inflicting emotional distress)
• Conduct or activities in violation of these Terms
• Any other content, display, materials and/or images that is or could be considered inappropriate, unsuitable or offensive, as determined by Insomniac, in its sole discretion

Insomniac is not obligated to use, publish, display or broadcast any Submission materials; provided however that you acknowledge that Insomniac will rely on your agreement and compliance with these Terms when you submit or attempt to submit your Submission.

Selected Potential Participants and Notification
Participants are restricted from any communication (announcing, telling any other person, posting online via website, blog or any social media profiles, pages or accounts) stating that they have been contacted or notified regarding a virtual set until Insomniac has fully verified eligibility and Insomniac has notified Participant that they have been approved to communicate their confirmation. 

Each potential participant is subject to verification by Insomniac. Insomniac will not accept screen shots or other evidence of participating in lieu of its validation process.  Potential participants must continue to comply with all terms and conditions of these Terms, and being selected is contingent upon fulfilling all requirements. Potential selected participants will be notified by email or phone on or about August 6, 2021. Potential selected participants will be required to sign and return a release required by Insomniac, which must be received by Insomniac within twenty-four (24) hours of the date the release is sent to the Potential selected participant. If a selected participant is a minor in his or her state of residence, the release must also be executed by the participant’s parents or legal guardians. If a potential selected participant cannot be contacted, fails to sign and return the contracts within the required time period (if applicable), or is otherwise unselected by Insomniac, such potential selected participant forfeits the ability to be selected and Insomniac will have no liability in respect to that potential selected participant.

Selected Participant(s) will receive one (1) set during EDC Las Vegas at Las Vegas Motor Speedway in Las Vegas, NV scheduled to take place on October 22-24, 2021 (“Event”); one (1) night standard accommodations; $500; and the Remix submitted by selected participants may be released on Insomniac’s label (to be determined at the sole discretion of Insomniac), in which case, selected participant(s) will be required to provide their submitted track as a .WAV master, pre-master, and instrumental version. Performance stage location, dates, times and length for the set is at sole discretion of Insomniac and are subject to change or cancellation for any reason. Set time will range from one (1) hour to one and one half (1 1/2) hours, subject to change. Insomniac is not required to fill all or any of the sets as participants are chosen at Insomniac’s discretion. Specific sets cannot be requested and sets will be filled at the discretion of Insomniac.

Publicity
Except where prohibited, participation in the Casting constitutes Participant’s consent to Insomniac’s use of Participant’s name, Submission, social media identity, likeness, photograph, voice, opinions, hometown and state for Casting purposes in connection with this Casting in any media, worldwide, without further payment or consideration.

Privacy
Information submitted by entrants will be collected by Insomniac’s systems based in the United States and such collection will be subject to applicable United States laws. Entrants may withdraw personal data upon request; however, entrant will be disqualified if personal data is withdrawn prior to the determination of the winner and fulfillment of the prize. Information submitted by entrants is subject to Insomniac’s privacy policy: https://www.insomniac.com/privacy-policy/. Your participation in this Casting constitutes consent for Insomniac to use your personal information solely for the purpose of administering the Casting, unless entrant has opted to receive e-mail communications from Insomniac.

Errors and Unauthorized Activity
Insomniac is not responsible: (1) for any incorrect or inaccurate information, whether caused by Participants, printing errors or by any of the equipment or programming associated with or utilized in the Submission; (2) for technical and/or communications malfunctions, errors or failures of any kind; (3) for unauthorized human intervention in any part of the Submission process or Casting; (4) for technical or human error which may occur in the administration of the Casting or the processing of Submissions; (5) for any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from your participation in the  Submission process; or (6) if no Submissions are offered a virtual set. If for any reason a Submission is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, your sole remedy is another Submission in the Casting, provided that if it is not possible to award another Submission due to discontinuance of the Casting, or any part of it, for any reason, Insomniac, at its sole discretion, may elect to accept a Submission after the Submission Period.  Insomniac reserves the right to cancel, suspend and/or modify the Casting, or any part of it, if any fraud, technical failures or any other factor beyond Insomniac’s reasonable control impairs the integrity or proper functioning of the Casting, as determined by Insomniac in its sole discretion. Any attempt by any person to deliberately undermine the legitimate operation of the Casting may be a violation of criminal and civil law, and, should such an attempt be made, Insomniac reserves the right to seek damages from any such person to the fullest extent permitted by law. Insomniac’s failure to enforce any term of these Terms shall not constitute a waiver of that provision.

Release
By participating in the Casting, you (a) release SidePiece, Insomniac, and their parent companies, affiliates, subsidiaries, successors, assigns, agents, representatives, officers, directors, shareholders, and employees, from any and all liability for any claims, costs, injuries, losses or damages of any kind arising in connection with your Submission, including the unauthorized or illegal access to personally identifiable or sensitive information; and (b) acknowledge that the foregoing parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to an offer for a festival booking.
