AOM Day Photo Contest

Official Rules

VOID WHERE PROHIBITED. DO NOT ENTER UNLESS YOU MEET THE ELIGIBILITY CRITERIA AT THE TIME OF ENTRY.

ELIGIBILITY: The NCCAOM Photo Contest ongoing ("Contest") is open to anyone aged 18 or older. The following individuals are not eligible: employees, contractors, directors, committee members, volunteers and officers of NCCAOM, agencies involved in the administration, development, fulfillment and execution of this Contest (collectively, "Contest Parties"), and the immediate family members of (spouse, parent, child, sibling and spouse or "step" of each), and those living in the same households as each such individual. Contest is void where prohibited.

OVERVIEW: The Contest entrants submit a photograph ("Entry"), 1080 pixels or more wide in landscape format. Twenty-three (23) Semi-Finalists will be chosen from eligible and approved Entries.
TO ENTER: Visit the NCCAOM’s Web Site at http://www.nccaom.org/AOMDay_Contest_2019 (the "Web Site") and follow the instructions to submit your photograph.

You may submit only one Entry. No correspondence about Entries will be entered into, nor will images be acknowledged or returned. If the required information is not included, the Entry will be disqualified.

Any Entry that meets the Entry Requirements, Content Requirements and Conditions of Entry specified below may be posted at www.nccaom.org and/or on other NCCAOM social media sites.

Notify NCCAOM at info@thenccaom.org, if you believe an Entry infringes on your or another’s intellectual property rights.

Entry Requirements:

A completed online entry form which includes: your name, business name, business phone number, city, state, ZIP code, e-mail address, business.
A release/waiver from the entrant and each individual who is featured in your photograph which states the entrant and all featured photograph participants consent to NCCAOM’s use of said photograph for marketing purposes which includes but is not limited to: NCCAOM’s newsletter, website and social media sites. A title for your ‘Entry’ - Limit of 150 Characters.
An original photograph – 1080 pixels or more in width (landscape format)

The Photograph must show multiple people.
The photograph must showcase one of the following:
- A practitioner at work which includes demonstration of an AOM technique (ex: Acupuncture, Moxa, Cupping)
- The study of acupuncture (ex: Friends studying for the NCCAOM exams together; or a class photo from an approved PDA Course)
- Events in the field of AOM or AOM Day events/event preparation. (ex: A photo you and friends decorating and planning for your AOM Day event)
Acceptable file formats include: jpeg, png

NCCAOM is not responsible for late or incomplete Entries. If a problem occurs in the online submission process or in uploading a photograph, Entrant should receive an "Error" message. However, the responsibility to electronically complete the Entry process and upload a photograph is the Entrant's responsibility and neither NCCAOM nor the Contest Parties shall be responsible for any photograph not actually received due to incomplete or improper transmission. Similarly, neither NCCAOM nor the Contest Parties have any obligation to advise Entrant of an incomplete Entry or photograph submission.

Once the entry form is completed and the Entry uploaded, the Entry is final and may not be modified, supplemented or edited. Submission of an Entry is also subject to the NCCAOM Terms and Conditions for User-Generated Content. NCCAOM may, in its sole discretion, void any entries that NCCAOM believes have been illegally produced and/or that fail to adhere to any of the requirements set forth in the Contest Rules.

Entry Restrictions:

Brand Image. NCCAOM maintains a wholesome image for its brand. Entries must properly reflect this brand image. NCCAOM’s determination on brand image shall be final.
Safety. NCCAOM promotes safety of the public in all AOM services; therefore, NCCAOM, in its sole discretion, reserves the right to disqualify any photographs depicting or showing unsafe conditions, or conditions not exemplifying practitioner responsibility to include even the "appearance" of unsafe conditions. NCCAOM’s determination of what constitutes an unsafe activity or condition shall be final.
No third party logos/intellectual property. Ensure that the photograph does not inadvertently contain another brand's logo or intellectual property as this will cause your photograph to be disqualified. Examples to watch for: logo on a baseball cap, sneakers or t-shirt, name/logo of a famous baseball diamond in the background of your photo or logo. The ONLY permitted logo is the NCCAOM^®, which is not required to be in your photograph, and will not influence the judging.

CONDITIONS OF ENTRY: Entrants warrant, acknowledge and represent through the submission of the photograph that the photograph:

is original
does not infringe the intellectual property, privacy, publicity rights, ownership or any other legal or moral rights of any third party;
has not been entered in previous contests or won previous awards;
is not unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic;
does not promote alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing);
does not defame, misrepresent or contain disparaging remarks about other people, companies, or organizations;
is suitable for public viewing.

NCCAOM’s determination as to whether the photograph violates the rights of any third party or the Contest Rules is final.

All photographs become the exclusive property of NCCAOM upon submission. Each Entrant irrevocably grants NCCAOM and its affiliates, legal representatives, assigns, agents and licensees, the unconditional and perpetual right and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, exhibit and/or otherwise use or reuse (without limitation as to when or to the number of times used), on an exclusive basis, each element of the Entrant's photograph, and use of the Entrant's name, likeness, and/or statements regarding his/her participation in this Contest (with or without using the Entrant's name) in any and all media without limitation as to time or territory, and without any compensation or approval from the Entrant or any other party. Entrant waives intellectual property rights, privacy/publicity rights or other legal or moral rights that might preclude NCCAOM’s use of any element of the photograph, and agrees not to sue or assert any claim against NCCAOM for the use of any element of the photograph or Entrant's Likeness or statements. Entrant further grants all end users of NCCAOM’s Web Site (a) the ability to rate, vote, review, comment on and tag the photograph; (b) the ability to send and distribute the photograph via e-mail, instant messenger, and via social media or other electronic means.

Entrant agrees to defend, indemnify and hold NCCAOM, the Contest Parties and their respective affiliates, officers, directors, agents, co-branders or other partners, and any of their employees (collectively, the "Indemnities"), harmless from any and all claims, damages, expenses, costs (including reasonable attorneys' fees) and liabilities (including settlements), brought or asserted against any of the Indemnities due to or arising out of the use of any element of Entrant's photograph, or the Entrant's conduct in submitting an Entry or creating a photograph, or otherwise arising from or in connection with the Entrant’s participation in this Contest.

SELECTION OF FINALISTS:

Round 1: The first Twenty-Three 23 eligible and accepted submissions will be entered as finalists.

Round 2: One finalist entry will be shared via NCCAOM's Instagram profile, in chronological order corresponding to when the entry was submitted, at a rate of one per day, beginning October 1, 2019, running through October 23, 2019. Entries will be awarded points based on engagement activities as laid out in the table below. The entry with the highest earned point value will be selected as the contest winner. (Only engagement activities from the Instagram post in the NCCAOM Photo Contest accumulated as of 11:59 PM October 24th, 2019 will be applied to the entry's score.)

The winners will be chosen, subject to verification, and will be announced on October 24, 2019.

A gallery of the Finalist Entries may be posted at the website showcasing the top trending entries. This gallery is for entertainment purposes only and does not reflect the final results.

An Entrant may encourage family and friends to engage with his or her Entry, but may not attempt to induce others to engage his or her Entry through the use of any incentive, sweepstakes or other promotion. Any use of automatic engagement methods by any party will void all such votes and will result in the Entry in question being declared ineligible and disqualified from the Contest. Any attempt by an Entrant and/or his/her family or friends or community to vote more than the one vote per entry, per person, per email address using "bot" technology and/or any other fraudulent mechanism, as determined by NCCAOM in its sole discretion, shall give NCCAOM the right to declare the Entry ineligible and disqualified from the Contest.

GENERAL CONDITIONS: Potential Finalists/ Winners are subject to verification, including without limitation, verification of eligibility and compliance with the Contest Rules. Notification of Finalist/ winner status must be kept confidential until the Finalists/ winners are announced by NCCAOM. Failure to comply with this requirement may result in disqualification. If for any reason the Contest is not capable of running as planned NCCAOM reserves the right, at its sole discretion to cancel, modify or terminate the Contest. Further, NCCAOM reserves the right, at its sole discretion, to disqualify any Entrant deemed to be (a) tampering or attempting to tamper with the entry process or the operation of the Contest; (b) violating the Official Rules; or (c) acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person. . Entrants agree that NCCAOM has the sole right to decide all matters and disputes arising from this Contest and that all decisions of NCCAOM are final and binding.

LIMITATIONS OF LIABILITY AND RELEASE: In consideration for the Entrant’s ability to participate in the Contest and/or through the submission of the Entrant’s photograph, the Entrant and anyone claiming by, through, or under the Entrant, hereby agrees to waive, release, discharge, and covenant not to sue NCCAOM, the Contest Parties, and their respective affiliates, officers, directors, agents, co-branders or other partners, and any of their employees (collectively the “Releases”) from and against any liability, claims, demands, or causes of action whatsoever, arising out of or related to any loss, damage or injury, that the Entrant may sustain arising from and/or related to the Entrant’s participation in the Contest whether caused by the negligence of the Releases or otherwise.

Winners List: A list of the twenty-three (23) finalists may be posted in the NCCAOM newsletter and on the NCCAOM website and social media sites.

Privacy: By submitting an Entry in this Contest, each Entrant agrees to the NCCAOM's use of the participant's personal information as described in the NCCAOM’s Privacy Policy.

Legal: This Contest and rules are governed by the laws of the State of Florida. Entrants agree, acknowledge and consent to, through the submission of a photograph and/or participation in the Contest, that all claims or disputes must be resolved exclusively in the federal or state court located in Duval County, Jacksonville, Florida. Entrant also agrees and acknowledges that in the event any of the provisions, or rules related to the Contest are held by a Court of competent jurisdiction to be invalid, void or unenforceable, the remaining provisions or rules shall nonetheless continue in full force and effect without being impaired or invalidated in any way.
